Legal conflicts in the application of fundamental human rights

In late February 2026, the 3rd International Scientific and Practical Conference on ‘Legal Conflicts in the Application of Fundamental Rights and Freedoms: Practical Aspects’ was held in Lviv.

The event was organised by the Administrative Court of Cassation within the Supreme Court, in collaboration with the All-Ukrainian Association of Administrative Judges, the project “Improving the Quality of Justice by Strengthening the Role of the Supreme Court in Ensuring Transparent, Accountable and Inclusive Justice” the OSCE Support Programme for Ukraine and the Eighth Administrative Court of Appeal.

The conference was the latest in a series of international professional events and was dedicated to discussing the theoretical and practical aspects of legal conflicts in the application of fundamental human rights.

Welcoming speeches were delivered by the President of the Supreme Court Stanislav Kravchenko, the President of the Administrative Court of Cassation within the Supreme Court Ihor Dashutin, the Deputy Head of the Office of the President of Ukraine Iryna Mudra, the Special Representative of the Organisation for Security and Cooperation in Europe, Ambassador Peter Maresh, the President of the Supreme Administrative Court of the Czech Republic Karel Šimka, and the President of the Association of European Administrative Judges Sylvain Mérenne.

During the conference, participants discussed the concept of European Union legal doctrines regarding the application of fundamental rights (in particular the approach of the Court of Justice of the European Union), the case law of the European Court of Human Rights and its application in the decisions of the Constitutional Court of Ukraine, as well as the issue of resolving conflicts in the legal positions of the Supreme Court.

Filipe Duarte Neves, a judge at the Lisbon Tax Court of Appeal, shared his experience of using artificial intelligence to reach more rational judicial decisions. Esther de Roy, Vice-President for International Cooperation and the Rule of Law at the Amsterdam Court, highlighted issues of leadership and ethics within the judicial system, whilst Richard Humphreys, Head of the Planning and Environment Division of the High Court of Ireland, discussed current conflicts of law regarding the application of fundamental rights in Ireland.

Representing the National School of Judges of Ukraine at the conference were Nataliia Akhtyrska, Head of the Training Laboratory for the Study of European Union Law, and Tetiana Fulei, Head of the Department for Research into Judicial Issues and Academic and Methodological Support for Judicial Education.

Discussions during the conference contributed to deepening professional dialogue on the application of fundamental rights and freedoms, as well as to the development of modern approaches to resolving legal conflicts in national and European law enforcement practice.
